The enactment of the Financial Services Commission Act in December 2001 established the British Virgin Islands Financial Services Commission (FSC) as an autonomous regulatory authority responsible for the permission, regulation, supervision of all financial services in and from within the BVI, which includes insurance, banking, fiduciary services, trustee business, company management, investment business, and insolvency services, as well as the registration of companies, limited partnerships and intellectual property. Since 2002, FSC assumed the responsibility for functions previously carried out by the Government through the Financial Services Department. FSC, as financial services regulator, is also responsible for promoting public understanding of the financial system and its products, policing the perimeter of regulated activity, reducing financial crime, and preventing market abuse.

Public Statement 16 of 2022 - PROTONFOREX Public Statements PROTONFOREX Tortola, British Virgin Islands - 04 October 2022 - The British Virgin Islands Financial Services Commission (the “FSC”) considers it necessary to issue this Public Statement in order to protect the customers, creditors or persons who may have been solicited to conduct business by PROTONFOREX and to make the general public aware that the entity has never been licensed or regulated by the FSC to carry on any type of financial services business. The details are: PROTONFOREX is falsely purporting to be authorised by the BVI Foreign Exchange Commission for the purpose of carrying out payment transaction services. The FSC, therefore, informs the public that the BVI does not have a Foreign Exchange Commission. The public is also informed that such services are required to be licensed and regulated by the FSC. The FSC hereby informs the public that PROTONFOREX is not and has never been licensed or regulated to carry on payment transactions or any other type of financial services business in or from within the Territory. Members of the public are advised to exercise extreme caution if solicited at any time to conduct business with PROTONFOREX. The public is invited to provide the FSC with any relevant information on any questionable entities which are purportedly operating in or from within the Territory and on any improper activities engaged in by such entities. The FSC has issued this Public Statement pursuant to Section 37A of the Financial Services Commission Act, 2001.
